As of January 1, 2026, California has officially shifted the landscape of residential tenancies with the implementation of Assembly Bill 414 (AB 414). This legislation modernizes the security deposit return process, aligning it with the digital-first habits of modern renters and property managers.

The Shift to Digital Returns

The core of AB 414 is simple: if a tenant pays their rent or initial security deposit electronically—via portals, apps, or direct deposit—the landlord must now return the remaining security deposit electronically. This moves away from the traditional "check in the mail" default, aiming to reduce delays and eliminate issues like lost or stolen mail.

Key Requirements of the Bill

While the 21-day timeline for returning deposits remains unchanged, AB 414 introduces several critical updates:

Electronic Default: Digital refunds are now the standard for digital payers unless both parties agree in writing to a different method (like a paper check).

Itemized Statements: Landlords can now provide the required itemized deduction statements via email, provided they have the tenant's prior written consent.

Multi-Tenant Protection: For leases with multiple adult tenants, the law requires the refund to be issued as a single payment made out to all tenants. This ensures all residents are notified and prevents one person from "absconding" with the funds without an agreement from the others.
